Terms of Service

1. Who can use VYREEL

• You must be at least 13 years old. VYREEL is not for children under 13.
• If you are 13 to 17, a parent or legal guardian must agree to these Terms for you, and they are responsible for your use of the Service.
• You must be allowed to use the Service under the laws that apply to you, and you can't use it if we have previously banned you.

2. Your account

• Give accurate information and keep it up to date. One account per person; don't share it or sell it.
• Keep your password and sign-in methods secure. You are responsible for activity on your account. Tell us right away at cody.brazier98@gmail.com if you think someone else has access.
• Before creating your first video, you confirm your age and agree to these Terms, the Content Policy, and the sending of your prompts and images to our AI providers. When these documents change in an important way, we ask you to agree again.

3. What VYREEL does

VYREEL turns your written prompts and source images into short AI-generated videos using third-party AI models, and offers tools to organize, download, and share them. Available models, settings, lengths, and prices may change, and we may add, change, or remove features. We try to keep the Service available but can't promise it will be uninterrupted. When our video provider is unavailable, VYREEL may show a maintenance notice and pause new videos; videos already in line wait and start automatically, or their credits are returned.

4. Credits, plans, and payments

• Credits. Videos cost credits. The price for your chosen model, quality, and length is shown before you start. Credits are held when a video is queued and returned automatically if it fails or is stopped by our safety checks.
• Credit packs are one-time purchases. Pack credits never expire while your account is open.
• Plans are monthly subscriptions that renew automatically until you cancel. Each renewal adds that month's plan credits; unused plan credits expire at renewal. Plan credits are used before pack credits. You can cancel anytime from Credits & billing, and your plan stays active until the end of the period you paid for.
• Free credits, such as the welcome credits after you confirm your email, are a one-time gift per person.
• Credits are a license to use the Service. They have no cash value, can't be transferred or sold, and can't be exchanged for money except through a refund under the Refund Policy or where the law requires.
• Website payments are processed by Stripe. Purchases inside the iPhone or Android app are processed by Apple or Google under their terms. Prices include any taxes we are required to collect where shown.
• Refunds follow the Refund Policy: unused credit packs can be refunded within 14 days of purchase. If a payment is refunded or reversed, the credits it bought are removed. Please contact us before disputing a charge with your bank; a disputed charge may pause your account until it's resolved.

5. Your content

• Yours to keep. You keep the rights you have in your prompts and images (“Inputs”). As between you and us, you own the videos and captions the Service creates for you (“Outputs”), to the extent the law allows. AI outputs may not be protected by copyright, and other people may receive similar outputs.
• Permission to run the Service. You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, and display your Inputs and Outputs only to provide, secure, and improve the reliability of the Service, to enforce these Terms, and as the law requires. This includes sending them to the AI providers described in the Privacy Policy. The license ends when you delete the content or your account, except for copies we must keep for legal reasons.
• No training. VYREEL does not use your Inputs or Outputs to train AI models, and we don't sell them.
• Your responsibility. Only use Inputs you have the right to use, and only make and share Outputs that follow the Content Policy and the law. Don't upload photos of other people without their permission. When you share realistic AI videos, label them as AI-generated where a platform or the law requires.
• Accuracy. AI output can be unexpected, inaccurate, or offensive despite our safety checks. Review Outputs before you use or share them.

6. Rules and enforcement

You must follow the Content Policy. Among other things, you must not create or try to create nudity or sexual content, anything that sexualizes or endangers minors, gore or graphic violence, realistic harm to people or animals, threats against real people, self-harm content, hate, or sexual, humiliating, or deceptive videos of real people. You also must not:

• try to get around our safety checks, for example with coded words, spaced-out letters, the Avoid box, or edited images;
• break the law, infringe anyone's rights, harass people, or impersonate anyone;
• use more than one account to avoid limits or a ban, or resell the Service without our written permission;
• scrape, copy, reverse engineer, or overload the Service, probe its security, or access it with bots except through features we provide.

Every prompt, Avoid entry, source image, and finished video is checked automatically. We may block requests, remove content, pause video creation, or suspend or close accounts that break these rules. Repeated blocked requests pause video creation automatically. We report apparent child sexual exploitation to the National Center for Missing & Exploited Children (NCMEC) and may share information with law enforcement when the law requires or to protect people from harm. If you think we made a mistake, contact us and we will review it.

7. Reporting content and copyright

Use Report AI output on any video, or email cody.brazier98@gmail.com. We review reports as quickly as we can, usually within two business days, and remove content that breaks our rules. To report copyright infringement, email us with your contact details, a description of the work, where the infringing material is on VYREEL, a statement that you believe in good faith the use isn't authorized, a statement under penalty of perjury that your notice is accurate and that you are authorized to act for the owner, and your physical or electronic signature. We may close accounts of repeat infringers.

8. Other services and app stores

The Service relies on third parties such as our hosting, database, payment, and AI providers. Their services are subject to their own terms, and we aren't responsible for them. If you download a VYREEL app from the Apple App Store or Google Play, these Terms are between you and us, not Apple or Google; Apple and Google aren't responsible for the app or its support, and the app store's terms also apply to your download. For apps from the App Store, Apple's standard Licensed Application End User License Agreement applies alongside these Terms, and Apple and its subsidiaries are third-party beneficiaries of these Terms who may enforce them against you.

9. Ending your account

You can stop using VYREEL at any time and ask us to delete your account from Settings or the account deletion page. Cancel any plan separately so it doesn't renew. We may suspend or close your account if you break these Terms, if required by law, or if we stop offering the Service; when we close the Service or an account without cause, we will refund unused purchased credits. Sections that by their nature should continue (such as content licenses for legal copies, disclaimers, limits of liability, and disputes) survive.

10. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we don't promise that Outputs will be accurate, unique, or suitable for any purpose. Some places don't allow these disclaimers, so they may not all apply to you.

11. Limits on liability

To the fullest extent the law allows, we won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. These limits don't apply where the law doesn't allow them, including for fraud or intentional misconduct.

12. Your responsibility to us

If someone brings a claim against us because of your content or your breach of these Terms or the law, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.

13. Disputes and governing law

If you have a problem, contact us first at cody.brazier98@gmail.com; most issues can be fixed quickly. If we can't resolve it within 30 days, either of us may bring a claim. These Terms are governed by the laws of the State of Tennessee and applicable US federal law, without regard to conflict-of-laws rules. Claims must be brought in the state or federal courts located in Tennessee, and both of us consent to those courts, except that either of us may bring an individual claim in small claims court where it qualifies. If you live somewhere that gives you the right to bring claims in your local courts or under local consumer law, nothing here takes that right away.

14. Changes and contact

We may update these Terms. If a change is important, we will tell you in the app or by email before it takes effect and ask you to agree again before your next video. If you don't agree, stop using the Service and you can ask us to delete your account. If any part of these Terms can't be enforced, the rest still applies. These Terms, together with the policies they link to, are the whole agreement between you and us about the Service.
